New details have emerged on the man responsible for Johnny Gaudreau's death
New details have emerged concerning Sean Higgins who was responsible for the death of Johnny Gaudreau and Matthew Gaudreau.
Johnny and his brother Matthew were struck by a vehicle near their home in Salem County, New Jersey, on Thursday night. Unfortunately, both Johnny and Matthew passed away as a result of the accident.
Evidence in the case against Higgins was provided to Judge Michael Silvanio that Higgins' blood alcohol level, which was obtained through a blood draw, was .087, over the legal limit of .08.
Recently, Higgins faced the judge again for a for a pre-indictment conference.
The two-minute hearing was mostly procedural as an agreement was made among counsel in judge's chambers ahead of time to give the state another 30 days to file a grand jury indictment, Superior Court Judge Michael Silvanio said.
First Assistant Prosecutor Jonathan Flynn of Salem County calling it "relatively straightforward," confirmed to Judge Silvanio Tuesday that after negotiation the state's original request for a 60-day window to file the indictment was shortened to a 30-day extension in agreement with the defense.
In court, Higgins' legal team agreed to the 30-day window to have the indictment filed. Higgins faces up to 20 years in prison if convicted.
-NBC Philadelphia Court records say Higgins admitted to passing the vehicle on the right and said his alcohol consumption played a role in his impatience and aggressiveness while driving.

That vehicle had moved to the left to make room for the Gaudreau brothers, who were cycling on the right shoulder.
